Seat belts save lives, and Tennessee law requires seat belts to be worn by the driver and passengers. But if you were involved in an accident and were not wearing your seat belt, the fact that you were not wearing your seat belt is not admissible into evidence except in limited circumstances. While seat belts are required to be worn by Tennessee law, there are exceptions. For example, if you have a physical disability (certified in writing by a physician) that prevents appropriate use of a seat belt, then you are excused from the State’s seat belt law. Likewise, the following persons are exempt under certain circumstances United States Postal Service workers and newspaper delivery persons who are performing their duties, meter readers performing their duties, vehicles in a parade, mechanics and salespersons at automobile dealerships, a vehicle participating in a hayride, a vehicle crossing a highway from one field to the other, an ADS or ADS-operated vehicle.

A police officer may write you a citation for a seat belt violation but can not arrest you for failure to wear a seat belt. Violation of Tennessee’s seat belt law is a Class C misdemeanor, and you can avoid a court appearance for the seat belt citation by paying the applicable fine. A seat belt violation shall not be assigned a point value for suspension or revocation of a driver’s license and it cannot be construed as any other offense.
