Who can serve as an expert witness in a Tennessee medical malpractice lawsuit?
Tennessee has some very specific rules about who can testify as an expert witness in a medical malpractice case.
Number one, that expert must be in the same specialty or substantially similar specialty as the person that he or she is testifying about.
Second, that expert witness must have practiced that specialty in Tennessee or a contiguous state.
Third, that expert witness must have performed those services during the one year prior to the negligent act or omission that is the subject of the malpractice suit.
And finally, the expert witness must be familiar with the local standard of care where the healthcare provider that is the subject of the malpractice suit, actually practiced medicine.
