Types of Cases We Handle in Fairview, Tennessee

The award-winning injury lawyers at The Law Offices of John Day, P.C. have been privileged to represent injury victims in Fairview and all of Williamson County. Unlike a lot of lawyers, we concentrate our practice on injury cases so we do not handle child custody cases, adoptions, real estate closings, divorces, bankruptcies, corporate matters, wills or trusts, DUIs or other criminal matters.

But, we do handle every type of injury case imaginable including trucking accidents, medical malpractice, dog bites, auto accidents, bus accidents, brain injuries, food poisoning cases, food allergy cases, drowning accidents and near-drowning accidents, burn injury cases, brain injury cases, cases involving injuries to the spinal cord (paraplegia and quadriplegia), carbon-monoxide poisoning cases, bicycle accidents, sexual abuse cases, eye injury casesmotorcycle accidents, nursing home abuse and neglect, summer camp accidents, broken bone injuries, uninsured and underinsured motorist claims, burn injuries, golf cart accidents, defective product cases, premise liability cases and many more.

Will I Have to Go to Court?

We handle each case with one goal in mind: getting you the maximum compensation reasonably possible in the shortest amount of time reasonably possible. Fortunately, most claims can be resolved without the need for trial. But sometimes, the at-fault party or the insurance company will refuse to take responsibility for the accident or they will deny the severity of your injury. When that happens, we will take your case to trial to ensure you receive the compensation you deserve.

Williamson County Judges and Court Information

If your case must go to trial, Fairview and Williamson County are part of the 21st Judicial District, and the judges "ride the circuit," which means they divide their time hearing cases in the four counties comprising the District. Because Williamson County has the largest population of the four counties, the judges spend a significant portion of their time in the county seat of Franklin.

The 21st Judicial District has one of the heaviest caseloads in the entire state, and the cases are heard by the following people:

The 21st Judicial District has Local Rules of Court that can be found here. These rules govern various topics such as motion dates, setting cases for trial, pretrial procedure, etc.

Like many places in Tennessee, there are relatively few personal injury, wrongful death and other types of tort cases tried in Williamson County. Below is information about the tort cases tried in the 21st Judicial District:

For 2010-2011, 261 tort cases (claims for personal injury or wrongful death) were filed in Williamson County and 5 tort cases went to trial. However, the injured party only won 2 of those trials and average award was 28,931.00. For 2011-2012, 246 tort cases were filed and 3 went to trial. Only one of those trials resulted in the injured party receiving compensation, and the award was only $2,000.00. For 2012-2013, 235 tort cases were filed in Williamson County and 8 tort cases were tried. The injured party received compensation in only 4 of those trials and the average award was $45,430.00. For the 2013-2014 reporting year, 237 tort cases were filed and 3 were tried. Of those three trials, the injury victim only won one and the verdict was for $22,997.00. Tort filings were up slightly in 2014-2015 with 255 filed. Four tort cases were tried and the injured party won 2 of those 4 trials. The average award was up slightly also at $39,913.00.  In 2015-2016, there were 261 tort cases filed, 4 of those cases went to trial, and 3 of the injured parties received awards for an average of $41,358.  During the 2016-2017 reporting period, 338 cases for injury or death were filed, two were tried, and both of those trials resulted in the injury victim receiving compensation.  The average award that year was $42,806.  For the 2017-2018 year, 325 injury or death cases were filed in Williamson County and five were tried.  Of those five trials, the injury victims won four of them, and the average award increased to $68,602.  Last year, the filings were almost identical with 326 tort or injury cases being filed.  Eight cases went to trial and the injury victims won three of those trials.  The average verdict jumped significantly to $4,199,054 due to a case handled by our office on behalf of an seriously injured pedestrian.  The other two verdicts last year were less than $1 million.  In fact, one was less than $100,000.   As a result, the verdict our Brandon Bass obtained was the substantial increase in the average award.

Experience Matters And We Have It

These statistics highlight the need for quality representation.  At the Law Offices of John Day, our team of experienced injury attorneys is proud of our results. We have won millions of dollars for our satisfied clients, and that money provided our clients with the financial security they needed following a serious accident.

And in cases where the injury was caused by a pattern or practice of reckless behavior, clients have been relieved to know the at-fault company or individual changed their practices so that future accidents could be avoided.
