What To Expect If Your Injury Case Goes To Trial In Shelby County

A tort case is a claim for personal injury or wrongful death. For the 2010-2011 reporting period, there were 1886 tort cases filed. Of those cases, only 79 went to trial and only 42 resulted in a verdict for the injured party. The average verdict was $81,887.00. For the 2011-2012 reporting period, there were 1,768 tort cases filed and again 79 cases went to trial. The injured party prevailed in 50 of those cases and the average award was $808,878.00. For 2012-2013, 1,747 tort cases were filed in Shelby County and 76 tort cases were tried. The injured party won 44 of those 76 trials with an average award of $247,527.0. In 2013-2014, 2,210 cases were filed and 95 were tried. The accident victim won 37 of those trials. One of those trials resulted in a verdict in excess of $33 million dollars, which skewed the average award. If that extremely large verdict is removed, then the average award was roughly $83,000.00. In 2014-2015, Shelby County saw 2,031 tort cases filed, 65 tried and 32 verdicts for injury victims. Yet again, Shelby County had the biggest verdict in the State at $30,000,000.00. If that verdict is removed from the equation, the average verdict in Shelby County last year was $68,442.67. In 2015-2016, 2,065 tort cases were filed. Of those cases 79 went to trial. Of the 79 cases that went to trial, 40 were awarded and average settlement of $385,120. For 2016-2017, injury and death case filings increased to 2,272.  71 cases were tried and the injury victim was successful in 52 of those trials.  The average award that year was $706,484.  The following year, 2017-2018, the injury and death filings remained steady at 2,279.  Shelby County judges tried 66 cases that year and the injury victim won 36 of them with a significantly lower average award of $200,791.  Finally, last year, injury and tort filings increased with 2,411.  There were 71 trials and 44 wins for injury victims. The average award was substantially higher at $2,650,439, but that amount was the result of one or two large verdicts because 35 of the 43 verdicts for the injury victim were under $100,000, and seven were under $1,000,000.  So only 3 verdicts exceeded the one million dollar mark.
